The General Data Protection Regulation (GDPR): In April 2016, GDPR was approved and went into effect on May 25, 2018. It is considered to be the world's strictest legislation on Data Protection and security since the UK's 1998 Data Protection Act. GDPR is focused on data security and privacy, and it significantly updates, extends, and harmonizes data protection legislation across the EU/EEA.

Who is subject to GDPR?

Individuals, organisations and companies that control or process personal data are subject to GDPR. In broad terms, there are three different Categories:

  •  Data subjects (Company Staff Members or anyone who makes a purchase, signs up to our news letter, who we receive emails from, Social Media such as Facebook, etc and this also includes phone conversations on any verbal consent given)
  • Data controllers (Miguel Hayworth - Managing Director at Sweet Victory Products ltd)
  • Data processors (Anyone or any systems that directly handle data, like staff members. This also includes the company accountant, Hughan Associates Limited, 33 Hughan Road, Stratford, London, E15 1LS. Xero, a cloud-based accountancy software, and Onesaas are used to transfer data from eBay to Xero, Shopify, PayPal, and eBay.)

As the company's data processor, we do not decide the purpose or lawfulness of the data we process and store. Sweet Victory Products Ltd. is acting on behalf of the customers. The data controller, Miguel Hayworth, its managing director, is ultimately responsible for documenting and deciding how data enters our company's systems. However, GDPR regulations impose stricter regulations on processors. Sweet Victory Products Ltd. will fully comply with these requirements for all of our services, including Xero, Onesaas, The Accountant, Shopify, eBay, and PayPal.

How does GDPR differ from the current UK Data Protection Act 1998?

Key areas of difference are explained in detail in our privacy policy, including increased corporate accountability, more access to personal data for individuals or customers, and penalties for non-compliance with GDPR.

GDPR gives consumers more protection on the rights of data subjects:

The data controller is the Managing Director, who is directly responsible for respecting these rights. The data processor, Sweet Victory Products Ltd, and all those involved in the company may assist in accomplishing these tasks. Any changes to data are logged and recorded by the data processors with the authorization of the Data controller.

With the update to the Terms of Use, we want to ensure complete transparency to build trust and establish our credibility as a company. We believe in handling data to a high standard, as our customers, visitors, and subscribers would expect. We understand that non-compliance with GDPR is a violation of GDPR Data Protection Laws. This includes any failure to report breaches within 72 hours to the Information Commissioner's Office, which may be subject to fines. The Information Commissioner's Office (ICO) is responsible for enforcing GDPR and has a broad range of powers to do so.

What kind of information is collected, and what information is Sweet Victory Products Ltd allowed to collect?

Sweet Victory Products Ltd is allowed to collect all personal information on any individual, which is what we refer to as the data subject. This is included under GDPR. Specifically, personal information that allows an individual to be identified, such as name, address, phone number, or any other descriptive information, falls under the GDPR law.

This also applies to any personal information that has been encrypted, pseudonymized, or anonymized. The scope of information of this nature will still fall under the GDPR if the data can be used to identify a specific individual.

In other words, if we can achieve reasonably similar outcomes and purposes without processing information, we do not have a lawful basis.

Are Sweet Victory Products Ltd compliant with GDPR laws?

We have been working towards compliance since May 25, 2018. We have implemented security measures on our e-store, including anti-virus, malware scanners, and firewalls. All data is stored on external drives, and paper files are kept in sealed boxes, with current information locked and secured. Additionally, our data mapping audit software has helped us prepare for the upcoming GDPR changes with a strong set of organizational and technical security measures.

Before our company was formed, its founder and director received training in the area of data protection. As a result, we have always prioritized safety and the protection of any information as our top priority. We expect to be fully compliant in line with GDPR regulations and provide reports and sufficient evidence that these changes to our company have been met.

To demonstrate our commitment to GDPR, you can expect Sweet Victory Products Ltd to:

  • Prioritize the security of our computer equipment and use secure storage units.
  • Provide any documentation when requested to demonstrate our compliance and keep customers informed.
  • Offer support for customers and clients to help them exercise their data subject rights.

How does Sweet Victory Products Ltd become GDPR compliant?

GDPR requires us to directly record and evaluate how personal data is processed and used. At a minimum, we are required to conduct a thorough review of user data from start to finish, justify why we hold it (using one of the legal bases), specify how long we will retain it, and perform a security review. The purpose of every data point we hold must be clearly defined.

In the case of our company, which is based in the UK, we must also comply with UK laws on file and record-keeping. It is the responsibility of the company director to keep records for 6 years and file and store them for that period of time. After this, we are required to responsibly and securely destroy the information.


Can any of our customers request the deletion of their own information under the "right to be forgotten"?

Under Article 17 of the GDPR, individuals have the right to have personal data erased. This is also known as the "right to be forgotten." However, this right is not absolute and only applies in certain circumstances.

The GDPR specifies two circumstances where you should inform other organizations about the erasure of personal data:

Can our customers exercise their rights using GDPR?

Under GDPR, the individual, who is the data subject, has rights that they can exercise, and these rights pertain to the interaction between the individual and the data controller. Food, Health and Hygiene.

Health, Hygiene, and Government Food Labeling Guidelines

Sweet Victory Products Ltd cannot accept responsibility for the conditions our products are exposed to after being dispatched from us. For example, sticky sweets or melted chocolate.

All sweets will be packaged in food-safe heat-sealed poly bags.

Sweet Victory Products Ltd will provide all ingredient and allergy information for each product available to us. However, we cannot guarantee that they are free from traces of nuts, milk, soy, and gelatine. If you have any food allergies or dietary needs, please check the ingredients displayed when ordering your sweets.

We cannot be held responsible for any health or safety concerns once you have received the product.

RETURNS

Our policy lasts 14 days distance selling, under the right to cancel any item purchased. If 14 days have gone by since your purchase, unfortunately, we can’t offer you an exchange, if you require a refund you have the right to request a refund within 48 hrs if you are in the UK, this includes made to order gift hampers of perishable goods, if you're outside the UK we can extend this to give time.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

For non defective products that are in satisfactory condition you are responsible for posting your return to us at your own cost.


Additional non-returnable items:

*Any and all opened products that are not sealed in original packaging.

You agree at your own expense to complete your return we require that this be returned to us by tracked gps service either via 48 hours or 24 hours or currier., we require a receipt or proof of purchase refunds are not an absolute right under the consumer rights act.

Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Sale items (if applicable)

Only regular priced items may be refunded, unfortunately, sale items cannot be refunded.

Exchanges (if applicable)

Fresh Produce, Cakes etc (Parishables)

Regarding orders for perishable goods, we kindly request a photograph of the product label to assist us in addressing any concerns with the supplier responsible for baking these items, Do not return these items to us as this is non refundable.

Please note that, in compliance with the standard policy for perishable goods, we are unable to issue refunds unless there is substantial evidence of a defect, damage, or if the "best before" date has passed. This matter is separate from the initial order, so please refrain from returning such items with your order. Instead, store them in the refrigerator, as they are custom-baked to ensure freshness, aligning with the policies upheld by bakery and bread companies.

As per Consumer Rights legislation, it's important to understand that cakes, being perishable in nature, are non-refundable unless they are found to be defective or damaged please send photographic evidence of this for the brand to issue a refund.

Any concerns regarding such products should be communicated via email within 7 days of receipt, in accordance with the product's specified "best before" shelf life. In the rare event that you simply do not like the cake, we regret to inform you that this does not warrant a refund.


 

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he/she will find out about your return.

International Customers.

Now that we are IOSS registered we can ship to the following countries in the European Union, EUROZONE Vat is charged at the checkout, please be aware we have no ETA once your order arrives in your country and is dealt with customs when your order processed and send to you through customs, we ask if you would be patient whilst this is being done and maybe subject to delays..

24hrs, 48 Hrs by royal mail or courier 1-3 days does not include the handling times before collection by royal mail or drop off, the dispatch time is from the moment the parcel serivices collect your orderf from the drop off and not before that.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

If you are shipping an item over £5, you agree to using a GPS trackable shipping service or purchasing shipping insurance without it we will not be able to guarantee that we will receive your returned item and a refund cannot be issued.

If no one is available to collect the item once a purchase is made and sent to the address after purchase and returned to us, if you still want the products that have been purchased you will be required to cover the postage costs of these being sent back to you.

RETURNS

Our policy lasts 14 days distance selling, under the right to cancel any item purchased. If 14 days have gone by since your purchase, unfortunately, we can’t offer you an exchange, if you require a refund you have the right to request a refund within 48 hrs if you are in the UK, this includes made to order gift hampers of perishable goods, if your outside the UK we can extend this to give time.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Additional non-returnable items:

*Any and all opened products that are not sealed in original packaging.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted: (if applicable)

* Any item not in its original condition, is damaged or missing parts for reasons not due to our error.

* Any item that is returned more than 48hrs days after delivery, if you are outside the UK we can extend this time as we understand that the transit of goods does take longer depending on what part of the world the product is sent.

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

Providing the car that is use to deliver your parcel will be sent out to you on the same day or next day, this is subject road conditions, collisions or the car is broken down we will then provide you with an alternative method of shipping at no extra cost to you.

  2. where an item is undeliverable and/or has been returned to sender due to the issues that the recipient was not in at the time and did not leave a safe place instruction the customer would be required to pay again for the parcel to be re-sent out.

  3. where the customer has changed to the alternative delivery arrangements have been agreed with the customer, including, for example, through the use of services such as Safeplace, PO Box delivery, Mail Collect and Post Restante, and the delay is caused by the customer or by the nature of the arrangements.

  4. where an item has been forwarded from the delivery address stated on the item other than by Postal service/currier under its redirection service,

  5. where postage payable for the item in question is unpaid or underpaid,

  6. where the complaint relates to an item posted with or handled by another postal operator or third party, other than when another postal operator or third party has posted the postal packet using a Royal Mail service or otherwise,

As you maybe aware Evri has been branded by the Citizen Advice Bureaux as one of the worst companies rated for reliability on Parcels in the whole of the UK, so why do people opt for this, because it is a low cost shipping solution and there is a saying you pay for you get, so why do we as a company include this in your shipping options?

Because you the consumer demand low cost options to shipping, this will come with risks to you, as using this service parcels have known to be damaged or go missing, but if you opt for this service you pay for evri's shipping costs, factoring in that there are significant issues with EVRi.

Please understand for this we Advise that you select DPD/UPS for your shipping to prevent any issues that may occur by using EVRi, yes this costs more but we place our emphasis on value for money for a better service we do not profit on shipping options the shipping companies set the prices that are passed onto you.



EVRi's Parcels are known to have gone missing or damaged in some circumstances and we understand this can be vexing for our customers, we ask that if you opt for this service that extra patience is needed as we work very hard to make sure that your orders arrive intact and in one peace.

To be fair to EVRi, the company has issued a response to this in (a link in there article) but as the saying goes, the proof to EVRi is in the proverbial pudding, which is why we added the following EVRi terms of shipping as your agreement between us as a company and our responsibilities to you, if you do choose EVRi as your shipping option.

Our Shipping conditions is that you understand that no parcel that is sent by EVRi cannot be a guarantee of delivery within the set time frame.

You agree to make sure that your order is fully and correctly addressed in a manner which includes all the elements of the postal address (including the full postcode).

  1. If the events within the company postal service royal mail or otherwise giving rise to the claim was caused by circumstances outside of the delivery service control or our control, including exceptionally severe weather conditions, acts of terrorism and vandalism and acts of third parties whom we have no contractual relationship, but excluding the failure of their companies employees, sub-contractors or agents of EVRi, to provide services to or for Sweet Victory Products ltd. as a result of industrial action (AKA strikes) by the method you have chosen to send your parcel in this we will work hard to ensure that your parcel will get to you as soon as humanly possible, 

  2. where an item is undeliverable and/or has been returned to sender due to the issues that the recipient was not in at the time and did not leave a safe place instruction the customer would be required to pay again for the parcel to be re-sent out.

  3. where the customer has changed to the alternative delivery arrangements have been agreed with the customer, including, for example, through the use of services such as Safeplace, PO Box delivery and the delay is caused by the customer or by the nature of the arrangements.

  4. where an item has been forwarded from the delivery address stated on the item other than by EVRi under its redirection service,

  5. where postage payable for the item in question is unpaid or underpaid,

  6. where the complaint relates to an item posted with or handled by another postal operator or third party, other than when another postal operator or third party has posted the postal packet using EVRi's service or otherwise, 

  7. where the delay has arisen through the posting or receiving customer’s own act or omission.

Our responsibility to you with regards to EVRi', we will make sure if a parcel is missing or delay occurs we will do everything to act quickly to resolve this with EVRi on your behalf within 10 working days should any disputes arise, we will seek to either seek to send a replacement or EVRi will compensate you the amount you had paid for any missing goods,

under distancing selling rules you can cancel your order up to 14 days after their order is delivered.

These rules do not apply to:

  • goods and services worth £42 or less
  • food and drink supplied regularly (like milkmen)

4) Product Inspection

Before consuming any food product, it is your responsibility to inspect it for any signs of spoilage, including but not limited to foul odors, mold growth, or unusual discoloration. If you notice any such signs, you should refrain from consuming the product and contact our customer support for assistance.

5) Liability

While we strive to provide the best quality products to our customers, we cannot guarantee the exact quality or taste of the food products beyond the Best Before End date. Therefore, we disclaim any liability for any adverse effects or dissatisfaction arising from the consumption of products that have passed their Best Before End date or experienced quality diminishment.

6) Storage Recommendations

To maximize the shelf life and quality of our food products, it is important to follow the recommended storage instructions provided on the packaging. These terms and conditions shall be governed by and interpreted in accordance with the laws of United Kingdom. Any disputes arising from these terms and conditions shall be subject the RetailADR and then to the exclusive jurisdiction of the courts in United Kingdom.
