These terms and conditions govern your use of our website. Please read these terms in full before you use this website. If you do not accept these terms and conditions, please do not use this website. Your continued use of this website confirms your acceptance of these terms.

The General Data Protection Regulation (GDPR), In April 2016 GDPR was approved and goes into effect on May 25, 2018. It is considered to be the world's strictest legislation on Data Protection and security since the U.K 1998 Data Protection Act, GDPR is focused on data security and privacy, and significantly updates, extends, and harmonises data protection legislation across the EU/EEA.

Who is subject to GDPR?

Individuals, organisations and companies that control or process personal data are subject to GDPR. In broad terms, there are three different Categories:

  • Data subjects (Company Staff Members or anyone who makes a purchase, signs up to our news letter, who we receive emails from, Social Media such as Facebook, etc and this also includes phone conversations on any verbal consent given)
  • Data controllers (Miguel Hayworth - Managing Director at Sweet Victory Products ltd)
  • Data processors (Anyone or any systems that directly handles data like Staff members, this also includes the company accountant Hughan Associates Limited, 33  Hughan Road, Stratford, London 
    E15 1LSXero cloud Based accountancy software, onesaas is used to transfer data from eBay to xero, ekm, Paypal and ebay)

The Companies Data processor, we do not decide the purpose or lawfulness of the data we process and store. As a company Sweet Victory Products Ltd is acting on the customers’ behalf. The data controller, Miguel Hayworth its managing director is ultimately responsible for documenting and deciding how data enters our companies systems. However, GDPR regulations do legislate stricter regulations on processors. As a company Sweet Victory Products ltd, will fully comply with these requirements for all of our services, including Xero, Onesaas, The Accountant, EKM, Ebay and Paypal.

How does GDPR differ from the current U.K. data protection act 1998?

Key areas of difference are explained in detail in our privacy policy on increased corporate accountability, more access to personal data for any individual or customer, penalties are subject to non-compliance of the GDPR. 

GDPR gives consumers more protection on rights of data subjects:

  • right to be informed
  • right of rectification
  • right of erasure
  • right to restrict processing
  • right of data portability
  • right to object
  • right of access

These rights are highlighted in our Privacy Policy, they explain framework for any interaction the company has between the data subject, controller, and processor.

The data controller is the Managing Director who is directly responsible for respecting these rights, the data processor Sweet Victory Products Ltd and all involved in the company may assist in accomplishing these tasks, any changes to data are logged and recorded by the data processors by the authorisation of the Data controller.

With the update to the Terms of Use we want to ensure our complete transparency to build trust and our credibility as a company, we believe in handling data to a high standard as our customers, visitors and subscribers would expect, we understand that ​​​​​​​non-compliance with GDPR is a violation of GDPR Data Protection Laws this includes any failier to report breaches within 72 hours to the Information Commissioners Office may be subject to fines. What kind of information is collected, and what information are Sweet Victory Products Ltd allowed to collect?

All personal information on any individual (is what we call the data subject) this is included under GDPR. Specifically, personal information that allows any individual to be identified — an example of this can be name, address, phone number or any description, etc. — is included under the GDPR law.

This also applies to any personal information has been encrypted, pseudonymised, or anonymized, the scope of information of this nature will still fall under the scope of GDPR if the data can still be used to identify a specific individual. ​​​​​​​

For most companies, the legal basis for collecting information relates to either legal obligations such as accounts and tax records, or to legitimate interests.

At Sweet Victory Products Ltd we require that the data processing is necessary part of what we do in terms of sales and receipts or marketing with consent even if that consent is already given, i.e. in other words, if we do reasonably the same outcomes and purpose without processing information would apply, then we do not have a lawful basis.​​​​​​​

Are Sweet Victory Products Ltd Compliant with the GDPR laws?

We are working for compliance for 25th May 2018. We have added security provided with our e-store this includes anti-virus, malware scanners and firewalls, all data is stored on external drives and paper files are under a sealed box and current information is under lock and key, amongst our data mapping audit software we feel we are well prepared for the upcoming GDPR changes with a strong set of organisational and technical security measures.

Before our company was formed its founder and director has been trained in the area of data protection and so we always believe safety around protecting any information is our top priority, we expect to be fully compliant in time for the new regulations and provide reports and sufficient evidence that these changes to our company has been met in line with GDPR regulations.

To show our commitment to GDPR, you can expect Sweet Victory Products Ltd to:

  • Prioritise our security for computer equipment and use secure storage units.
  • Provide any documentation when requested to demonstrate that we are compliant and keep customers informed.
  • We will offer support for customers and clients to help them exercise their data subject rights.

How does Sweet Victory Products Ltd become GDPR compliant?

GDPR does require us to directly record and evaluate how personal data is processed and used. At a minimum, we are required to fully review user data end-to-end, justify why we hold it (using one of the legal bases), for how long we will retain it, and conduct a security review. The purpose of every data point you hold must be defined.

In the case of our company, it is based in the UK and so must comply also to uk law on files and record keeping, it is the responsibility of the company director to keep records for 6 years to be filed and stored for such a period of time, after this we are required to destroy the information responsibly and securely.

Can any of our customers request deletion of there own information under “right to be forgotten”? 

Under Article 17 of the GDPR individuals have the right to have personal data erased. This is also known as the ‘right to be forgotten’. The right is not absolute and only applies in certain circumstances.​​​​​​​

The GDPR specifies two circumstances where you should tell other organisations about the erasure of personal data:

  • the personal data has been disclosed to others; or
  • the personal data has been made public in an online environment (for example on social networks, forums or websites).

Can our customers exorcise there rights using GDPR?

Under GDPR, the subject who is the Individual, and their rights is between the person and the Data controller. Any data subject requests from any visitor or customer with regards to Sweet Victory Products Ltd, relevant information will be handed over to the customer. Sweet Victory Products Ltd, will  work to cooperate in good faith, we will work with customers with customers to ensure they can exercise the rights of the data subjects in a prompt manner, this can be expected within one month upon the date the request was given..​​​​​​​

Food, Health and Hygiene.

Sweet Victory Products Ltd cannot accept responsibility for the conditions our products are exposed to after being dispatched from us. For example: Sticky sweets or melted chocolate.

All Sweets will be packaged in food safe heat sealed poly bags.

Sweet Victory Products Ltd will supply all ingredient and allergy information for each product that is available to us, we cannot guarantee that they are free from traces of nuts, milk, soya, and gelatine. If you have any food allergies or dietary needs please check the ingredients displayed when ordering your sweets.

We can not be held responsible for any health or safety concerns once you have received the product.

RETURNS

Our policy lasts 14 days distance selling, under the right to cancel any item purchased. If 14 days have gone by since your purchase, unfortunately, we can’t offer you an exchange, if you require a refund you have the right to request a refund within 48 hrs if you are in the UK, this includes made to order gift hampers of perishable goods, if you're outside the UK we can extend this to give time.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Additional non-returnable items:

*Any and all opened products that are not sealed in original packaging.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted: (if applicable)

* Any item not in its original condition, is damaged or missing parts for reasons not due to our error.

* Any item that is returned more than 48hrs days after delivery, if you are outside the UK we can extend this time as we understand that the transit of goods does take longer depending on what part of the world the product is sent.


Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Sale items (if applicable)

Only regular priced items may be refunded, unfortunately, sale items cannot be refunded.

Exchanges (if applicable)

We only replace items if they are defective or damaged.  If you need to exchange it for the same item, send us an email at info@sweetvictoryproducts.co.uk and send your items to: 59 Donnington Avenue, Cheadle, SKP, SK8 2DL, United Kingdom.

 

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he/she will find out about your return.

 

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over £5, you should consider using a trackable shipping service or purchasing shipping insurance. We cannot guarantee that we will receive your returned item.

RETURNS

Our policy lasts 14 days distance selling, under the right to cancel any item purchased. If 14 days have gone by since your purchase, unfortunately, we can’t offer you an exchange, if you require a refund you have the right to request a refund within 48 hrs if you are in the UK, this includes made to order gift hampers of perishable goods, if your outside the UK we can extend this to give time.

To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.

Additional non-returnable items:

*Any and all opened products that are not sealed in original packaging.

To complete your return, we require a receipt or proof of purchase.

Please do not send your purchase back to the manufacturer.

There are certain situations where only partial refunds are granted: (if applicable)

* Any item not in its original condition, is damaged or missing parts for reasons not due to our error.

* Any item that is returned more than 48hrs days after delivery, if you are outside the UK we can extend this time as we understand that the transit of goods does take longer depending on what part of the world the product is sent.


Refunds (if applicable)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)

If you haven’t received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Next contact your bank. There is often some processing time before a refund is posted.

Sale items (if applicable)

Only regular priced items may be refunded, unfortunately, sale items cannot be refunded.

Exchanges (if applicable)

Gifts

If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he/she will find out about your return.

 

Shipping

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

If you are shipping an item over £5, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.
